The Centre today filed an affidavit in the Supreme Court on the validity of triple talaq and polygamy, reports said.
The affidavit said there is no reason women in India should be denied their constitutional rights. "Gender equality and dignity of women are non-negotiable, overarching constitutional values and can brook no compromise," the Centre said to the apex court, according to The Times of India. "Religious practices cannot be an impediment to rights and aspirations of individual woman irrespective of religion she practices," it added.
The Muslim law board had earlier observed that triple talaq falls under personal laws and could not be modified by the Centre. However, the government, led by the Bharatiya Janata Party (BJP), made its stand on the matter clear.
"Validity of triple talaq and polygamy has to be seen in light of gender justice, equality and dignity of women," it said in the affidavit, adding that polygamy and triple talaq do not adhere to constitutional values and, therefore, cannot be accepted.
