Delhi Police File FIR Against Uber In Rape Case

The Uber rape case today stalled proceedings in Rajya Sabha, the upper house of Parliament, even as the Delhi Police filed an FIR against the private cab service for 'cheating and violating a government order'. No Uber official will be named in the FIR, police sources said.

The central government was considering banning Uber across the country, according to PTI. Union Transport Minister Nitin Gadkari said he was against such a ban.

Mumbai police chief Rakesh Maria has instructed the crime branch to check records of all cab companies and their drivers.

A police investigating team has recovered clothes worn by the accused, Shiv Kumar Yadav, and found two of three cellphones they said he was using over the past few days. Police said bite marks have been found on the survivor's body. A 25-year-old woman has accused Yadav of raping her on the night of December 5, 2014 while she was on her way back from a pub in Gurgaon.

Rajya Sabha erupted in protests against the rape. Parliamentarians demanded stricter transport laws.

Gadkari said: "The incident has happened because of driving licenses. We will change Motor Vehicle Act and will have a central record system with all details of drivers (such as any accidents, medical reports or others)." Approximately 30 per cent of licenses are fake, Gadkari was quoted as saying by NDTV.

A case has been registered against Uber under Sections 420 (cheating), 188 (violating a government order) and 34 (common intention) of the IPC for misleading customers into believing their cabs are operating safely in Delhi. Uber told Delhi Police they do not conduct the background checks themselves but relied on the police for verification, reported Times of India.

"Uber is not an authorised radio cab service and has been operating illegally," the Special Commissioner of Delhi Transport Department Satish Mathur told the Economic Times.

Yadav has refused to undergo Test Identification Parade (TIP), used by the police to help a witness pick an accused from a lineup of suspects.

The Delhi government decided to ban all internet-based taxi firms after the incident, Reuters quoted a government official as saying on Tuesday.

The Delhi transport department issued a public notice stating that only six registered radio taxi companies are allowed to operate in New Delhi, according to the Reuters report. "We have banned Uber. Another public notice will be issued tomorrow for banning all non-registered cab service providers. It's almost done," Kuldeep Singh Gangar, spokesman of the Delhi's transport department, told Reuters.

Uber officials are likely to be questioned today, according to NDTV.
