A 5-Pronged Approach To Fighting Child Marriage

In a major setback for child rights in Pakistan this month, a bill to ban underage marriage -- the Child Marriage Restraint (Amendment) Bill 2014 -- was withdrawn at the last minute because of the pressure from the Council of Islamic Ideology (CII). Sadly, it looks like the law will not be protecting children in Pakistan any time soon, but this is not the only country in South Asia in which this dubious "tradition" continues to be perpetuated.

Child Marriage, Rape And The Loopholes Of The Law

Section 375 of the Indian Penal Code, 1860 (amended) states that a man is said to have committed rape, if he does any of the intrusive sexual acts as enlisted in Section 375, with a girl below 18 years of age, with or without her consent. However, Exception 2 of the same Section provides that sexual intercourse by a man with his own wife, the wife not being under fifteen years of age, is not rape!

A Legal Right To Rape

The Supreme Court of India recently dismissed a plea by a woman to declare marital rape a criminal offence. The petitioner alleged that she was repeatedly subjected to sexual violence by her husband, including having torch lights pushed into her. Sadly, she has no legal recourse: according to Section 375 of the Indian Penal Code, sexual intercourse by a man with his wife, the wife not being under 15 years of age, is not sexual assault, even if it is without consent.
