Delhi University professor G N Saibaba was granted bail by Supreme Court on Monday and the apex court reprimanded the Maharashtra government for being ''extremely unfair' to him. Saibaba was arrested for his alleged links with Maoists organisations.
The court also criticized the counsel for Maharashtra for opposing his bail plea on the grounds that some prosecution witnesses still need to be examined.
“You have been extremely unfair to the accused, especially looking at his medical condition. If material witnesses have been examined, then there is no point in putting him in jail,” the bench, comprising Justices J.S. Khehar and C. Nagappan, said.
Disagreeing with the counsel, the court granted bail to the professor who is 90% disabled and has several serious health issues.
In January, the professor had written an anguished four-page handwritten letter to the principal judge of the Gadchiroli district and sessions court, seeking special medical treatment and dietary provisions on the ground that his health is deteriorating fast.
“I have been suffering from multiple ailments of severe nature and have been taking regular treatment at the Indian Spinal Injuries Centre (ISIC), New Delhi, for my left shoulder, which was damaged seriously in prison,” the professor said in his letter dated January 5, 2016.
Housed in the Nagpur jail, the professor has been granted bail after most of the 34 prosecution witnesses were examined. In one of its earlier order the court had directed the Maharashtra government to make alternative arrangement keeping the health conditions of the professor in mind.
